Employer Guide To Company Cars & Vans

A company vehicle is a car or van owned or leased by a business and used either by the owner/director of the company or given to an employee for their use. Find out all about the benefits and responsibilities in our guide!

What is a Company Car or Van?

A company vehicle can be given to one individual or else provided as a pool car or van for several employees to use. It can be given as a necessary tool for the employee (including the director) to enable them to do their job, or in recognition of an employees’ status or contribution to the company. A company car can be provided for combined business and private usage or else for business use only.

A ‘company car’ can be offered by any type of employer - not just a ‘company’. Types of businesses that typically offer company vehicles include sole traders and other types of self-employed persons, Limited Liability Partnerships (LLP), charities, embassies, local or government Authorities as well as Limited Liability Companies (LTD) and Public Limited Companies (PLC).

A note on company directors: The benefits and taxation rules are the same for employees as they are any company director being given a company car or van, therefore where the term ‘employee’ is used, this includes any company director being given a company car or van.

Employer Benefits

Employers can benefit from offering company cars or vans in the following ways:

  • Provides control over the safety and reliability of the vehicle employees drive
  • Provides control over the company image projected to clients and customers
  • Offers an effective way of rewarding employees and securing new staff
  • Provides an additional means of advertising the business
  • Facilitates a better understanding of the location of vehicles through the fitting of tracker devices/GPS (and so be able to provide real-time information back to the company/customer)
  • Ensures a vehicle is available for use by other staff members, should an employee leave or falls sick
  • Encourages a greater sense of staff loyalty and satisfaction

Employee Benefits

The employee benefits of being given a company car or van are:

  • Access to a vehicle without having to personally pay for it or be personally tied to a financial contract (albeit they will need to pay benefit in kind tax for any private usage)
  • Potential access to a better car or van than they could otherwise afford themselves
  • Enjoy additional savings due to on-road expenses usually being included (e.g. servicing, repairs and maintenance)

  • Avoid most of the responsibilities and problems that come with personally owning a car or van (e.g. depreciation risks, the effort of selling the vehicle)

Employer Responsibilities

Financial Risk

Owning a company vehicle (i.e. either purchasing one outright or via an on-going payment system that results in ownership) can be a beneficial but costly venture for any business. This is because this route usually requires large up-front payments, plus the long-term upkeep can be expensive. Ownership also brings with it aging-vehicle problems such as reduced reliability and safety, depreciation risk and financial loss on selling, not to mention the challenge of finding a buyer. 

Leasing (rather than owning) a company car or van, however, can help businesses avoid some, if not all, of these risks and also offers a VAT efficient and very low risk (and hassle-free) strategy for providing company vehicles.

Administration

Where the company vehicle is owned by the business (i.e. is purchased), the business is responsible for all administrative tasks relating to it (i.e. MOT, road fund licence, breakdown cover, servicing, maintenance, and repairs). However, if the vehicle is leased, most of these features are included in the lease package, meaning the business doesn’t have to concern itself with organising nor paying for these. Moreover, the leasing company usually provides an on-going paper trail for the vehicle, further lessening the administrative load. 

The administrative responsibility and load of offering a company vehicle differ significantly depending on whether the vehicle is owned or leased.

Safety/Duty of Care

Importantly, employers who offer company vehicles (whether leased or owned by the company or employee) have a legal ‘duty of care’ to employees to ensure vehicles supplied are safe. The Health and Safety at Work Act 1974 requires employers to ensure the health and safety of employees, as well as others who may potentially be affected by their activities when ‘at work’. As such, the company car or van (as well as any vehicle driven by an employee who is accepting a company vehicle allowance) is viewed as a ‘place of work’.

Consequently, all businesses should have a tailored company vehicle policy drawn up, and this should be explained to and signed by employees in acknowledgment that they have read and understood the terms. In addition, businesses should also conduct risk assessments.

Ensuring Employees Understand Their Responsibilities

As an employer, you’ll need to ensure that your employees understand what their responsibilities are when being offered a company car or van, including:

  • If any fuel allowance provided is used for private journeys, they will need to pay Car/Van Fuel Tax Benefit every month. To find out more, see our easy to read employee guide to fuel allowance
  • They must have a valid driver’s licence (that will be checked frequently by the business)
  • Only authorised drivers can drive the vehicle (with the exception of mechanics conducting repairs and persons assisting in emergencies)
  • If car or van insurance isn’t included in the package, employers will need to arrange and pay for this themselves, including appropriate business insurance cover

  • They must adhere to the usage agreement. If the vehicle is for business-usage only it should not be ‘available for private usage’
  • They will need to read, sign and comply with the employer’s company vehicle policy including any requirements or restrictions on the vehicle itself and how it is used, (company vehicle policies can include restrictions on who can drive the vehicle, who can travel in it, what it can be used for)
  • If they will be claiming for fuel or mileage expenses, they must keep a detailed, accurate logbook of journeys for tax purposes (stating the date, start and finish locations, start and finish odometer readings and whether the journey is for a business or private purpose)


Considerations and Drawbacks

Employers should also consider the following factors when offering company cars or vans:

  • Driver licence checks should be mandatory (with licences checked annually or more often, depending upon mileage driven)
  • The business is responsible for all administration relating to the vehicle including arranging and paying for MOT (if applicable), tax disc, breakdown cover, insurance, servicing, maintenance, repairs etc. If the vehicle is leased however, most of these features come as part of the package and the leasing company will handle these
  • Ensure a company car/van policy is in place to protect the business and employees
  • If the company vehicle is leased, the business should consider placing restrictions on employee vehicle choice in terms of engine type and size and body type. This will help to protect not only the employee and the business (in its legal duty of care responsibilities), but will also ensure the correct image of the business is projected.   • Consider whether the vehicle should be provided solely for business purposes or for combined business and private usage, as any private usage will require the company to pay Employer Company Car/Van Tax i.e. Class 1A National Insurance Contributions or NIC.   • Consider whether to also offer employees a fuel allowance or fuel card.   • The employer is responsible for paying for both servicing and maintenance of the vehicle
  • Consider whether the business will also offer motor insurance as part of the package
